Terms of Use

Lore’s AI systems include guardrails to prevent misuse. The safety guardrails are designed to:

• prevent the promotion of self-harm, violence, and harmful ideation
• prevent identifying as a human or person, or displaying human traits, emotions, and behaviors
• prevent uses that are hateful, exploitative, extreme, or illegal
• prevent over reliance, companionship, personal attachment, friendship, and intimacy
• prevent use for automated determinations and decision-making
• prevent violations of Lore’s policies and Terms of Use
• prevent giving information that qualifies as therapy or health care

Lore is not designed to:

• give you advice, guidance, instructions, or recommendations, including plans or checklists
• provide medical, diagnosis, or treatment information.

Our AI safety guardrails are not static, they evolve and aim for excellence. We continuously refine, test, and monitor our AI safety guardrails. We use automated safety flags to signal user actions that may be problematic. We also build controls directly into our technology to prevent inappropriate behavior by our AI systems. The safety flags and technical controls are reviewed weekly for any suspicious patterns and failures that require investigation. These methods enable Lore to be vigilant and persistent in AI safety, while keeping humans in the loop along the way.

If you choose to use Lore, you agree that you will only use it in ways that are legal and safe, as allowed under these Terms. You are NOT allowed and strictly prohibited from any action that tries to make Lore’s AI systems break our safety guardrails. We do not tolerate repeated attempts to misuse Lore. If you try to engage Lore’s AI systems in prohibited ways, we will give you one warning to stop the prohibited activity. We call this warning a strike. During a strike, we will freeze your Lore account for 24 hours. Further strikes or actions by you that violate our AI safety guardrails may result in permanent loss of access to your Lore account and a ban on joining Lore in the future.

To help preserve your privacy, we treat any information you share with us in accordance with our Privacy Notice, and all applicable laws, rules, and regulations. You are responsible for reading our Privacy Notice to understand how we collect, use, and share data. Your personal information will only be used for one or more of the following purposes:

1) to better serve your account and preferences
2) to monitor accounts and enforce our Terms of Use
3) to analyze and improve our operations, products, and services for you
4) to comply with any disclosures required by laws or under our contracts
5) to deidentify and/or aggregate your personal information.

In choosing to receive our services, you consent to these uses of your personal information, and you can modify your preferences at any time.

Getting Verified. We want our app to be secure and safe for everyone. We actively work to prevent fraud, data scraping, bots in our community, and other bad actions that seek to hurt Lore and our users. So, we limit some features to only users who choose to get “verified”, which helps us make sure a user is NOT a malicious actor. Choosing to get verified means you would direct Lore to associate your Lore account with one of our corporate partners where we have a financial relationship. Verified users can:

• Redeem points for rewards
• Have an unlimited number of LoreBot chat messages
• Make posts and comments on posts in our community feature

If you want to know what data we collect from you and how to access a copy of that data, please review our Privacy Notice at https://www.lore.co/privacypolicy. You can also ask us to delete your data by pushing the Delete My Account button on Lore’s mobile app and website, or by emailing hello@lore.co with “Delete Account” in the subject line of your email. We will review and respond to all data requests within 45 days. We will work to verify and fulfill your request. Sometimes, we may have legal reasons and obligations that prevent us from completing a data request. If we cannot complete a data request due to legal reasons or obligations, we will explain why and offer to disable your account until our commitments have been fulfilled, and we can proceed with your request. We are serious about comprehensive, rigorous, and effective data privacy and security practices, but data security is never perfect. This is why we use a data privacy and security framework that was independently developed by an organization called HITRUST. The HITRUST framework is widely considered to be the gold standard for privacy and security of health data. You can see more information about HITRUST at www.hitrustalliance.net. Our website and services may contain forums, bulletin boards, chat areas, message boards, feeds, groups, communities, and/or other message or communication channels designed to help you to communicate with other users. We caution you against publicly posting personally identifying information about yourself through our website and services. If you share your contact information with other users, they may gain access to personal information about you through other means outside our control. We are not responsible for the release of personal information by others about you.

We reserve the right, but are not obligated, to monitor information posted in any public area of our website and services. We retain the right to remove any information our staff deems to be harmful.

Some information on our website and in our services is user-generated content that we host. We are not the creator, publisher, or speaker of user-generated content. Our website and services will enable you to upload or post a wide variety of information and content. We do not own the information you choose to upload or post through our website and services. We host your user-generated content and use it with your permission. We are not responsible for the truthfulness, accuracy, or nature of user-generated content.

If you participate in our website or services, you may earn points for certain activities. Points are not money. You do not own these points. We retain sole and absolute discretion to adjust points and rewards at any time. Points and rewards are subject to availability and may be changed or no longer offered without notice. Lore offers rewards “as is” and does not guarantee all retailers or products are eligible. Without limiting the foregoing, Lore is not liable for rewards issues such as: declined transactions; merchant disputes; loss, forfeiture, or expiration of points; and acts or omissions by third-party vendors, payment networks, issuing banks, or merchants. No In-App Purchases. We do not have in-app purchase capabilities. Users cannot buy points or currency in our app. We do not collect fees of any kind from users.

Compliance and Regulatory Limits. Lore’s rewards are designed to comply with all federal and state laws. To maintain compliance, Lore reserves the right to make any necessary changes including but not limited to: modify rewards categories; restrict certain products or merchants; deny redemption requests; or reverse transactions.

Non-Monetary Rewards. Points may be redeemed to unlock non-monetary digital features and tools within our app. These features and tools have no monetary value and are not financial instruments. Access to these non-monetary rewards is subject to availability and rewards rules.

Rewards Cards. Certain redemptions may result in the issuance of a rewards card. For security, only “verified” users can access rewards cards. If you lose your verification status, you will immediately lose access to any monetary value on a rewards card. Rewards cards have monetary value. You do not own the monetary value on rewards cards. They are produced, issued, and administered outside of Lore by our rewards partner, InComm Payments, a leader in global payments technology. Lore does not: supply rewards cards; hold money; or conduct financial transactions in the Lore platform. Other reward cards limits include:

• May be limited to specific merchant categories, merchant networks, or product catalogs;
• Declined transactions outside of permitted categories;
• May operate on Visa or other payment networks, and be subject to network limitations;
• Are subject to configurations and restrictions selected by Lore;
• May require activation and completion of verification steps before use;
• May be subject to regulatory requirements.

Reward cards have limited monetary amounts for a participant’s use. Monetary amounts are available in United States dollars. Reward cards may be issued by a participating financial institution. You are responsible for protecting your rewards card and should immediately report lost or stolen cards. Unauthorized transactions may not be recoverable.

Prohibited Uses. We may suspend or terminate your Lore account for any of the following prohibited actions: attempt to convert rewards to cash; engage in fraud, abuse, or misuse; attempt to sell or trade redeemed rewards; attempt to circumvent merchant or catalog restrictions; use rewards for unlawful purposes.

Modification or Termination. At any time and without prior notice, we may: modify rewards and rewards rules; change eligible activities; adjust points conversions; change reward categories; or end rewards. Any unused points may be forfeited upon termination.

Tax Responsibility. You are solely responsible for determining if receiving or using points or rewards has any tax consequences. Lore does not provide tax advice.

We reserve the right to modify or discontinue, temporarily or permanently, our website or services at any time. We also reserve the right to determine, in our sole discretion, if you have taken an action that violates our Terms of Use. If you violate our Terms of Use, we may suspend or terminate your access to our website and services without prior notice. We may also suspend or terminate your account if you upload or post information that violates copyrights or intellectual property rights that belong to other people or companies.

We may update our Terms of Use at any time and will notify you of changes. You will always be able to review changes and choose if you want to continue using our website and services.

You understand and agree that you are solely responsible for your actions and decisions related to using our website and services, and interacting with other people through our website and services. We do not perform psychological testing or background checks on people who may use our website and services. You should take all reasonable precautions in using our website and services, which includes but is not limited to: remaining anonymous; verifying information; and doing your own research.

Our website and services are for your personal and non-commercial activities. You may not use our website or services for any other purpose. You may not advertise, solicit, or offer to sell any products or services on our website or through our services, without express written permission from us. You agree not to trade, share, sell, or transfer any physical or virtual items that we license to you or third-party products you receive through our website or services. You agree not to copy, distribute, use, change, or publish any part of our website, except as allowed under our Terms of Use.

To access certain parts of our website and services, you may be asked to register and provide additional information. You agree that all information you provide to us is truthful and accurate to the best of your knowledge.

We may send you mail or emails when we need to contact you about your account. You agree to receive business-related communications from us and you acknowledge that these communications are not unsolicited commercial advertisements. You will have the opportunity to modify your notification preferences in your personal account at any time. You will have the opportunity to choose if you want to receive information from us in the form of “push notifications”. Any cell phone carrier fees are your responsibility.

You acknowledge and agree that using our website and services does not give you ownership rights or other rights in this information or technology. All non-user generated information, third-party products, and services on this website and all technology used in connection with services provided through our website, are our property or the property of our third-party service providers.

Before you upload or post information through our website and services, you are required to review our Privacy Notice. If you choose to proceed with uploading or posting information through our website and services, you acknowledge and agree to provide us with a worldwide, perpetual, fully paid-up, royalty-free, unlimited, non-exclusive license that permits us to analyze, modify, aggregate, deidentify, or use the information in any manner consistent with our Privacy Notice. We will not sell user information under this license.

You agree that you will NOT use our communication services to upload or post any harmful content. At our sole and absolute discretion, harmful content is defined as but is not limited to information that is considered illegal, offensive, vulgar, obscene, pornographic, incendiary, indecent, threatening, abusive, racist, harassing, libelous, defamatory, or misinformation. It is possible that other users will upload or post harmful content to our website. We are not responsible for these transmissions, but we will take action to remove harmful content from our website or services.

We encourage you to report any harmful content on our website and services by pushing the Help button on our mobile app and website or emailing us at admin@lore.co with “Content Alert” in your email subject line and a description of your concern. We will directly respond to any reports of harmful content and describe how the incident is being handled. We may suspend or terminate a user’s access to our website and services for posting or uploading harmful content. You are responsible for any activities that take place under your username and password. If you become aware of any unauthorized use of your account, or any other breach of security, please contact us immediately by pushing the Help button on Lore’s mobile app and website or emailing admin@lore.co with a “Unauthorized Account Use” in your email subject line and a description of the unauthorized activity so that we may promptly investigate.

Our website and services may include hyperlinks to other websites which are not maintained by or related to us. You acknowledge and agree that we are not responsible for loss, damage, cost, or injury as a result of you choosing to access hyperlinks. We are not responsible for the content of any hyperlinked websites. Hyperlinks to other websites are accessed at your own risk.

You acknowledge and agree that the website, technology, and any third-party products you access, use, or receive through our website and services are all protected by intellectual property laws and other laws. No intellectual property rights are transferred or assigned to you by using the website, technology, or third-party products.

You agree to comply with all applicable laws regarding your use of our website and services, and any third-party products or services you receive through us or our affiliates. You are not permitted to use the website, services, or products to: violate any law; post information that advocates or could reasonably serve to encourage illegal, harmful, or violent activity; or discuss an intent to commit an illegal act or violate any law, rule, or regulation. If you are outside the United States, you agree to comply with all local laws.

Nothing in our Terms of Use nor your use of our website and services shall be construed to constitute a partnership, joint venture, employment, or agency relationship. Using our website and services does not give you the right or authority to incur, assume, or create any warranty, liability, or other obligation on behalf of us and our affiliates.

You agree to indemnify and hold harmless Lore Health LLC and our employees, directors, and affiliates, from any liability, loss, claim and expense, including reasonable attorney's fees, related to your violation of our Terms of Use.

You acknowledge and agree that using our website and services is at your own risk, including any third-party products or services you receive through us. The information on our website and in our services is provided on an "as is" basis. It may contain errors and defects. Opinions, statements, or other comments should NOT be relied upon or construed as professional advice from us or our affiliates. Also, we do NOT guarantee the accuracy or completeness of any information provided and we are not responsible for loss resulting from your reliance on such information. Subject to applicable law, any third-party products or services you receive through us are provided on an “as is” basis. We are not the product manufacturer or service provider of any third-party products or services you receive. We do not distribute, sell, or resell third-party products or services. You must look to the third-party product manufacturer or service provider for any warranties or guarantees. We do not warrant the safety, quality, or efficacy of any third-party products or services. We disclaim all warranties of any kind, whether express or implied, including without limitation, any warranty of condition, merchantability, quality, title, or fitness for a particular purpose. We are not responsible for any taxes in connection with your participation in our website or services. If your jurisdiction does not allow limitation on warranties, your only remedy is to stop using our website and services.

To the maximum extent permitted by law, Lore and its officers, directors, affiliates, employees, and agents, shall not be liable for direct, indirect, incidental, special, consequential, exemplary, or punitive damages relating to your use of our website and services, including any rewards. You acknowledge and agree that we are not liable for the conduct of users or their user-generated content on our website or in our services. This includes but is not limited to loss of revenue or profits, loss of data, loss of goodwill, pain and suffering, emotional distress, and damages that are incidental, direct, indirect, punitive, actual, consequential, special, or exemplary. You agree that we are not liable to you or any third party for modifying, suspending, or discontinuing our website or services. Your only remedy for dissatisfaction with our website or services is to stop using them. In no event will collective liability exceed the greater of $100 USD or the amount you paid us, if any, in the past 6 months for use of our website or services. The limits in this section apply even if a remedy in this section fails its essential purpose.

We will terminate accounts of users who post user-generated content that violates copyright law. If you believe our website or services contain information that has been copied in a way that constitutes copyright infringement, or your intellectual property rights have otherwise been violated, please provide a notice containing the following information to our copyright agent Copyright Compliance Department, Lore Health LLC, P.O. Box 431002, Minneapolis, MN 55443-5002, admin@lore.co:

• An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
• A description of the copyrighted work that you claim has been infringed;
• A description of where the information that you claim is infringing is located on our website or in our services;
• Your address, telephone number, and e-mail address;
• A statement by you that you have a good-faith belief that the disputed use is unauthorized by the copyright owner, its agent, or the law; and
• A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

You agree that the laws of the state of Delaware, without regard to conflicts of laws provisions, will govern our Terms of Use and any dispute that may arise between us. You agree that any claim arising under our Terms of Use must be filed within 1 year after the claim arose.

If any provision of our Terms of Use is found to be unenforceable or invalid, all other provisions will remain in full force and effect.

Our failure to exercise or enforce any right or provision of our Terms of Use shall not operate as a waiver of such right or provision. Any waiver by us must be in writing and signed by an authorized representative.

We reserve the right to release any information, including personally identifying information, as necessary to satisfy applicable law, regulation, legal process, governmental request, fraud protection, enforce our contracts and agreements, or protect the rights, property, or safety of our users and customers. We reserve the right to fully cooperate with law enforcement authorities or court orders that request or direct us to disclose the identity of users believed to violate this Terms of Use.
